This agreement describes the terms on which you may access and use the services of VideoAResume, LLC. In order to become a BlazitResume user, you must read and accept all of the terms and conditions of this agreement.

We reserve the right to modify this Agreement at any time, and without prior notice, by posting amended terms on this website. Your continued use of VideoAResume's service indicates your acceptance of the amended User Agreement.

Description of Service

BlazitResume is Flash technology website that provides its members with superior quality video storage technology and video editing services. BlazitResume embeds a multimedia technology into a classical resume document, creating a professional Hi-Tech Resume.

Membership Eligibility

1. In order to access some features of the Website, you will have to create a BlazitResume account. You may never use another's account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify VideoAResume immediately of any breach of security or unauthorized use of your account.
2. VideoAResume will not be liable for your losses caused by any unauthorized use of your account.
3. BlazitResume is not available to minors under the age of 18 or to any users suspended or removed from the system by VideoAResume for any reason. Users are prohibited from selling, trading, or otherwise transferring your BlazitResume account to another party.

Membership Account Guidelines

BlazitResume creates a member's web presence through a uniquely assigned MyWebpage. BlazitResume allows a user defined unique KeyName to represent their MyWebpage. There is one KeyName assigned per MyWebpage that displays one Video Resume. Members can have multiple Video Resumes by creating additional KeyNames.

Basic Membership Package

The BlazitResume Basic Membership package is provided as a FREE service to our members. This Basic Membership package has a limited one time offer and profile revisions are not available in Basic. Any package revision requests by a Basic member, requires the user to upgrade from their Basic membership to a FEE based package account.

• Deleting your account is not advised. Accounts with a preferred assigned KeyName once deleted the KeyName can not be recovered.
• Videos submitted for the purpose of our Basic Membership package must comply with all You Tube's terms of use

BlazitResume - FEE based services

• Video editing services apply to one video. (i.e. the first uploaded video)
• One complete editing session consists of video editing features, set by the selected membership package.
• The video editing process will commence, once a video and resume has been successfully submitted through the site.
• Video editing process time may vary and is estimated at 3-5 business days.
• You will be contacted via email regarding any unforeseen delays.
• The video editing process is complete, upon receipt of an email notification containing your applicable MyWebpage(s) and Hi-Tech Resume documents.

Video Editing Service Terms

BlazitResume offers FEE based video editing and storage services. BlazitResume members do not have any associated renewal fees to maintain their existing online profiles and Hi-Tech Resumes. However, requesting to revise an existing profile requires additional fees. See our Price List. BlazitResume reserves the right to modify this renewal fee policy (if it deems necessary), by notifying its members of this policy change via email.

• Requests to re-edit your previously uploaded video, is considered a new order.
• Requests to upload another video to an existing profile, is considered a new order.
• Hi-Tech Resumes.pdf are a secured document. Requests to re-edit previously created PDF file, is considered a new order.

Uploading Data Requirements

• Video shall not be longer than 2 minutes in length
• Max Video file size 2 GB
• Required Video formats: .AVI, .MPEG, .MOV, .WMV
• Required Classical Resume format: MS WORD

Video Disclaimer

• Video recordings submitted with substandard quality will adversely effect the final video rendered.
• I.E. If your RAW video is not recorded correctly in the beginning, there is not alot that can be done to fix it.
• VideoAResume, LLC will not held responsible for substandard submitted video material.

Privacy and Confidentiality

• VideoAResume does not provide password protection for playing videos.
• VideoAResume does not guarantee the privacy of your video's on the Internet.
• VideoAResume does not guarantee privacy of MyWebpage(s) and makes no guarantee from appearing on other websites or search engines.

General Use of the Website

VideoAResume hereby grants you permission to access and use the Website as set forth in these Terms of Service, provided that:

1. The content on the BlazitResume Website, except all User Submissions (as defined below), including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to VideoAResume, and are subject to copyright and other intellectual property rights under the law. Content on the Website is provided to you AS IS for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. VideoAResume reserves all rights not expressly granted in and to the Website and the Content.
2. You may access User Submissions solely:
   • for your information and personal use;
   • as intended through the normal functionality of the BlazitResume Service; and
   • for Streaming.

   "Streaming" means a contemporaneous digital transmission of an audiovisual work via the Internet from the BlazitResume Service to a user's device in such a manner that the data is intended for real-time viewing and not intended to be copied, stored, permanently downloaded, or redistributed by the user. Accessing User Videos for any purpose or in any manner other than Streaming is expressly prohibited. User Videos are made available "as is."

3. You agree not to circumvent, disable or otherwise interfere with security-related features of the BlazitResume Website or features that prevent or restrict use or copying of any Content or enforce limitations on use of the BlazitResume Website or the Content therein.
4. You understand that when using the BlazitResume Website, you will be exposed to User Submissions from a variety of sources, and that VideoAResume is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against VideoAResume with respect thereto, and agree to indemnify and hold VideoAResume, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.

Your User Submissions and Conduct

You understand and agree not to use BlazitResume to:

• Post content or initiate communications which are unlawful, libelous, abusive, obscene, discriminatory, or otherwise objectionable.
• Use the BlazitResume Service for any illegal purpose, including but not limited to conspiring to violate laws. Falsely state, impersonate, or otherwise misrepresent your identity, including but not limited to the use of a pseudonym, or misrepresenting your current or previous positions and qualifications, or your affiliations with a person or entity, past or present.
• Upload, post, email, transmit or otherwise make available any content or initiate communications which include information that you do not have the right to disclose or make available under any law or under contractual or fiduciary relationships (such as insider information, or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
• Upload, post, email, transmit or otherwise make available any content or initiate communication that infringes upon patents, trademarks, trade secrets, copyrights or other proprietary rights.
• Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes" or any other form of solicitation. This prohibition includes but is not limited to
• Using BlazitResume invitations to send messages to people who don't know you or who are unlikely to recognize you as a known contact;
• Using BlazitResume to connect to people who don't know you and then sending unsolicited promotional messages to those direct connections without their permission; and
• Sending messages to distribution lists, newsgroup aliases, or group aliases.
• Upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
• Stalk or harass anyone.
• Forge headers or otherwise manipulate identifiers in order to disguise the origin of any communication transmitted through the BlazitResume Service.
• Post content in fields that aren't intended for that content. Example: Putting an address in a name or title field.
• Interfere with or disrupt the BlazitResume Service or servers or networks connected to the BlazitResume Service, or disobey any requirements, procedures, policies or regulations of networks connected to the BlazitResume Service.

As a BlazitResume account holder you may submit video content ("Video Resumes") and textual content ("User Profile"). When these User Submissions are published, VideoAResume does not guarantee any confidentiality with respect to any User Submissions.

You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorize VideoAResume to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Service.

For clarity, you retain all of your ownership rights in your unedited video content Submissions and also any videos editing by our editing packages. However, by submitting User Submissions to BlazitResume, you hereby grant VideoAResume a worldwide, non-exclusive, royalty-free, sublicense able and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the BlazitResume Website and VideoAResume's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the BlazitResume Website (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the BlazitResume Website a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, display and perform such User Submissions as permitted through the functionality of the Website and under these Terms of Service. The above licenses granted by you in User Videos terminate within a commercially reasonable time after you remove or delete your User Videos from the BlazitResume Service. You understand and agree, however, that VideoAResume may retain, but not display, distribute, or perform, server copies of User Submissions that have been removed or deleted. The above licenses granted by you in User Comments are perpetual and irrevocable.

In connection with User Submissions, you further agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant VideoAResume all of the license rights granted herein.

VideoAResume does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and VideoAResume expressly disclaims any and all liability in connection with User Submissions. VideoAResume does not permit copyright infringing activities and infringement of intellectual property rights on its Website, and BlazitResume will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights. VideoAResume reserves the right to remove Content and User Submissions without prior notice.

Account Termination Policy

1. VideoAResume will terminate a User's access to its Website if, under appropriate circumstances, they are determined to be a repeat infringer.
2. VideoAResume reserves the right to decide whether Content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement, such as, but not limited to, pornography, obscene or defamatory material, or excessive length. BlazitResume may remove such User Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.

You agree that VideoAResume may, with or without cause, immediately terminate your BlazitResume account and access to the BlazitResume Service without prior notice. Without limiting the foregoing, the following will lead to a termination by VideoAResume of a user's use of the BlazitResume Service (a) breaches or violations of this User Agreement or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) unexpected technical issues or problems, and (e) extended periods of inactivity. Termination of your BlazitResume account includes removal of access to all offerings within the BlazitResume Service and may also bar you from further use of the BlazitResume Service. Furthermore, you agree that all terminations shall be made in VideoAResume's sole discretion and that VideoAResume shall not be liable to you nor any third-party for any termination of your account or access to the BlazitResume Service.

International Use

Recognizing the global nature of the Internet, you agree to comply with all applicable local rules including but not limited to rules regarding online conduct and acceptable content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.

Information Provided on this Website

In the course of using the BlazitResume Service, users may provide information about themselves which may be visible to certain other users. You understand that by posting materials on the BlazitResume website or otherwise providing materials to BlazitResume, you are granting to VideoAResume a royalty-free, perpetual, irrevocable license to use this information in the course of offering the BlazitResume service. Furthermore, you understand that VideoAResume retains the right to reformat, excerpt, or translate any materials submitted by you. You understand that all information publicly posted or privately transmitted through the BlazitResume Service is the sole responsibility of the person from which such content originated and that VideoAResume will not be liable for any errors or omissions in any content. You understand that VideoAResume cannot guarantee the identity of any other users with whom you may interact in the course of using the BlazitResume Service. Additionally, we cannot guarantee the authenticity of any data which users may provide about themselves or relationships they may describe.

Access to Service

Use of manual or automated software, devices, or other processes to "crawl" or "spider" any web pages contained in the BlazitResume website is strictly prohibited. You agree not to monitor or copy, or allow others to monitor or copy, our web pages or the content included herein. You also agree not to "frame" or otherwise simulate the appearance or function of this website. Furthermore, you agree not to take any action that interferes with the proper working of or places an unreasonable load on our infrastructure, including but not limited to unsolicited communications, attempts to gain unauthorized access, or transmission or activation of computer viruses.

BlazitResume Communications

In the course of providing you services, BlazitResume may need to communicate with you via email. You agree to receive emails which are specific to your account and necessary for the normal functioning of the BlazitResume Service. You also agree to have your name and/or email address listed in the header of certain communications which you initiate through the BlazitResume Service.

Monitoring and Enforcement

While we have the right to monitor activity and content associated with the BlazitResume Service, we are not obligated to do so. And since we do not, and may not have the ability to, control or actively monitor content we don't guarantee its accuracy, integrity or quality. Because community standards vary and individuals sometimes choose not to comply with our policies and practices, in the process of using our website, you may be exposed to content that you find offensive or objectionable.

You can contact info@blazit.com to let us know of content that you find objectionable. We may investigate the complaints and violations of our policies that come to our attention and may take any action that we believe is appropriate, including, but not limited to issuing warnings, removing the content or terminating accounts and/or subscriptions. However, because situations and interpretations vary, we also reserve the right not to take any action. Under no circumstances will we be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of, access to, or denial of access to any content on the website.

Fees

VideoAResume reserves the rights to charge for website services or any portion thereof, modify the pricing of, add to, or discontinue the BlazitResume Service or any portion thereof without prior notice.

Indemnification

By accepting this User Agreement, you agree to indemnify and otherwise hold harmless VideoAResume, LLC, its officers, employees, agents, subsidiaries, affiliates and other partners from any direct, indirect, incidental, special, consequential or exemplary damages resulting from i) your use of the BlazitResume Service; ii) unauthorized access to or alteration of your communications with or through the BlazitResume Service, or iii) any other matter relating to the BlazitResume Service. Any business transactions which may arise between users from their use of BlazitResume are the sole responsibility of the users involved.

Without limitation of the terms and conditions set forth in our Privacy Policy, you understand and agree that VideoAResume may disclose personally identifiable information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to comply with legal process, enforce this User Agreement, or protect the rights, property, or safety of VideoAResume, its users, and the public.

Disclaimer of Warranties

YOU UNDERSTAND AND AGREE THAT THE BLAZITRESUME SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND THAT VIDEOARESUME DOES NOT ASSUME ANY RESPONSIBILITY FOR PROMPT OR PROPER DELIVERY, OR RETENTION OF ANY USER INFORMATION OR COMMUNICATIONS BETWEEN USERS. VIDEOARESUME ASSUMES NO RESPONSIBILITY FOR THE ACCURACY OR EXISTENCE OF ANY COMMUNICATIONS BETWEEN USERS. VIDEOARESUME EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

VIDEOARESUME MAKES NO WARRANTY THAT (i) THE BLAZITRESUME SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE BLAZITRESUME SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE BLAZITRESUME SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE BLAZITRESUME SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE BLAZITRESUME SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM VIDEOARESUME OR THROUGH OR FROM THE BLAZITRESUME SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS USER AGREEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Entire Agreement

The User Agreement constitutes the entire agreement between you and VideoAResume and governs your use of the BlazitResume Service, superseding any prior agreements between you and VideoAResume.

Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT BLAZITRESUME SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF BLAZITRESUME HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT WILL BLAZITRESUME'S TOTAL CUMULATIVE DAMAGES EXCEED US$ 100.

Governing Law

The User Agreement between you and BlazitResume LLC will be governed by and construed in accordance with the laws of the State of Massachusetts without regard to conflict of laws principles.

General Information

Hi-TechResumes, the BlazitResume logo, and Blazit logo and names are trademarks of VideoAResume, LLC. You agree not to display or use these trademarks in any manner without VideoAResume's prior, written permission.
